Assistant Professor Dr. Abdullah Abdul Amir Taha, a professor of civil law at our college, chaired a committee to discuss a master’s thesis entitled “Guiding Sources for Civil Judges – A Comparative Study,” submitted by student Mustafa Ali Abdul Husseini.
The study aimed to understand the concept of guiding sources for civil judges, the importance of using them, their types, the determinants of resorting to them, and their impact on building the legal foundation and preserving the legislative and judicial system.
The study concluded that guiding sources represent an effective tool for bringing legislative texts closer to reality and transforming them from an abstract to a concrete form. Furthermore, the philosophy of resorting to guiding sources for civil judges is based on the inherent deficiency in legislative texts, which in turn leads to the inability of legislative texts to keep pace with emerging and evolving situations.
